1. Overview
Ch4pter, LLC ("Ch4pter") respects the intellectual property rights of others and expects its users to do the same. Ch4pter operates a technology marketplace on which independent Service Providers and Clients upload and exchange content, including portfolio images and private galleries. In accordance with the Digital Millennium Copyright Act (the "DMCA"), 17 U.S.C. § 512, Ch4pter responds to valid notices of claimed copyright infringement and, in appropriate circumstances, terminates the accounts of users who are repeat infringers.
This page explains how to submit a notice of claimed infringement, how to submit a counter-notification, and Ch4pter’s repeat-infringer policy. It should be read together with the Terms of Service and Privacy Policy.
2. Designated Copyright Agent

3. Filing a Notice of Claimed Infringement
If you are a copyright owner, or authorized to act on behalf of one, and you believe that content available through the Platform infringes your copyright, you may submit a written notice to the Designated Copyright Agent. To be effective under 17 U.S.C. § 512(c)(3), your notice must include substantially the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list);
- Identification of the material that is claimed to be infringing and that is to be removed or disabled, with information reasonably sufficient to let Ch4pter locate it (for example, the URL or a description of where it appears on the Platform);
- Your contact information — name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorized to act on the owner’s behalf.
Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.
4. What Happens After a Valid Notice
Upon receiving a notice that substantially complies with the requirements above, Ch4pter will act expeditiously to remove or disable access to the identified material, and will take reasonable steps to notify the user who posted it that the material has been removed or disabled. Ch4pter may, in its discretion, provide the user with a copy of the notice (which may include your contact information) so they can determine whether to submit a counter-notification.
5. Counter-Notification
If you are a user whose material has been removed or disabled and you believe the removal was the result of a mistake or misidentification, you may submit a written counter-notification to the Designated Copyright Agent. To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must include substantially the following:
- Your physical or electronic signature;
- Identification of the material that has been removed or disabled and the location at which it appeared before it was removed or disabled;
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, mailing address, and telephone number; and
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Ch4pter may be found), and that you will accept service of process from the person who submitted the original notice or their agent.
If Ch4pter receives a valid counter-notification, it may forward the counter-notification to the party who submitted the original notice and inform them that it may restore the removed material in 10 to 14 business days, unless the Designated Copyright Agent first receives notice that the original complaining party has filed a court action seeking to restrain the allegedly infringing activity.
6. Repeat Infringer Policy
It is Ch4pter’s policy, in appropriate circumstances and in its sole discretion, to disable and/or terminate the accounts of users who are determined to be repeat infringers. Ch4pter maintains an internal record of valid infringement notices and the actions taken in response. A user who is the subject of repeated valid notices of claimed infringement may have their account restricted, suspended, or terminated, and may be prevented from creating new accounts. Ch4pter may also, in its discretion, terminate an account for a single instance of egregious infringement or other serious misconduct, consistent with the Terms of Service.
7. Changes to This Policy
Ch4pter may update this page and its Designated Copyright Agent information from time to time. The current version governs; material changes will be reflected by the "Last Updated" date below.
